Terms & Conditions

These Terms and Conditions (the “Agreement”) are an agreement between you (“User” or “you” or “your”) and Kinetic Innovative Technologies Sdn Bhd (“KITSB”, “the Company”, “we”, “us”). By accessing or using any of our services, you agree to be bound by these Terms.

Company content

All content available through the Services — including software, design, text, images, logos, and trademarks — is the proprietary property of the Company or the Company's licensors. You may not copy, redistribute, or build derivative works without our written consent.

User content

By submitting content to our Services, you grant KITSB a non-exclusive, royalty-free, worldwide right and licence to use, reproduce, publicly perform, and otherwise utilise your User Content for the purposes of operating and improving the Services.

Billing & payment

It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. Accepted payment methods include MOLPay, PayPal, VISA, Mastercard, and bank transfer to KITSB.

You are responsible for the payment of all taxes, fees, levies, and charges related to your use of the Services. If you fail to maintain valid payment, your services will be suspended.

Renewal & reminders

We will issue renewal reminders in advance of expiration (typically 30 days, with a follow-up at 7 days) so you have time to renew or cancel.

Termination & data deletion

For dedicated and managed services, customers must provide thirty (30) days' written notice through billing@kitsb.com.my for termination.

After 3 months, the data will be permanently deleted and cannot be restored.

Backups

It is solely your responsibility to maintain backups. KITSB is not responsible for files and/or data lost due to user error, third-party action, or service termination. We recommend regular external backups of any data you cannot afford to lose.

Affiliate program

If you participate in the KITSB affiliate program: Minimum commission claim is RM100. Affiliate claim currency is in MYR only. Other terms of the affiliate programme apply as published.

Privacy Policy

Scope: All Kinetic / KITSB websites and services

This Privacy Policy describes how Kinetic Innovative Technologies Sdn Bhd collects, uses, and discloses information about you when you visit our websites, use our services, or interact with our products.

What we collect

  • Personal data — name, shipping address, email, and phone number you provide when signing up, purchasing, or contacting us.
  • Derivative data — information our servers automatically collect when you access the Services (IP address, browser type, access times).
  • Financial data — payment information needed to process transactions. This is processed by payment providers, not stored by us in plain form.

How we use information

  • To create and manage your account, deliver the Services, and respond to your requests.
  • To send transactional notifications, renewal reminders, and (with your consent) marketing communications.
  • To comply with applicable laws and respond to lawful requests.
  • To improve, analyse, and secure our Services.

Payment processors

Payment information you provide is processed by trusted third-party processors: PayPal, KineticPay, BitCoin, VISA, and MasterCard. Each processor handles your financial data according to its own privacy and security standards.

Cookies & tracking

We use Cookies and web beacons to enhance Services, remember preferences, and analyse traffic. You can disable cookies in your browser settings, but some features may not function correctly without them.

Information sharing

We may share information with service providers who help us operate the Services, with analytics and advertising partners, and where required by law. In the event of a sale, merger, or bankruptcy, your information may be transferred to the acquiring entity.

Security

We take reasonable administrative, technical, and physical steps to protect your information. However, no method of transmission or storage is foolproof, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

Your choices

You may request access to, correction of, or deletion of your personal data by contacting hello@kitsb.com.my. Note that deletion may affect your ability to use the Services.

Section 03

Cancellation Policy

Applies to: Hosting, domains, SaaS, and managed services

Notice period

A minimum notice period of 30 days is required for all cancellation requests. Notice should be submitted in writing to billing@kitsb.com.my with your account details and the services to be cancelled.

Refund window

Refunds are applicable only within 30 days of the initial service activation. Cancellations beyond this window do not qualify for a refund of fees already paid.

Pro-rated refunds

Where applicable, pro-rated refunds may be available for the unused portion of the service, excluding setup fees and any applicable taxes. Domain registration fees are generally non-refundable once the domain is registered.

Termination by KITSB

KITSB reserves the right to terminate Services in cases of policy violations, non-payment, or breach of these Terms. In such cases, refunds are at KITSB's sole discretion.

Data backup before cancellation

It is the client's responsibility to back up all data before termination.

Once cancellation is processed, accounts and associated data follow our standard data retention period and will be permanently deleted thereafter.

Section 04

Acceptable Use Policy

Applies to: All KITSB services and infrastructure

This Acceptable Use Policy (“AUP”) governs activities permitted on our infrastructure and services. By using any KITSB service, you agree not to engage in any of the prohibited activities below.

Prohibited activities

Phishing & identity theft Operating phishing pages, harvesting credentials, or impersonating individuals or organisations.
Malicious code Distributing malware, viruses, worms, trojans, ransomware, or any code designed to disrupt or damage systems.
Adult content Hosting adult, pornographic, or sexually explicit content on our infrastructure.
Violence & terrorism Content promoting, glorifying, or facilitating violence, terrorism, or hate against individuals or groups.
IP infringement Copyright, trademark, patent, or other intellectual-property infringement — including pirated software, films, or music.
Fraud Operating fraudulent schemes, deceptive billing, or any activity intended to defraud customers, partners, or third parties.
Reputation damage Activities that damage the reputation of KITSB, our infrastructure providers, or our other customers.
Spam & unsolicited messaging Sending bulk unsolicited email, SMS, WhatsApp messages, or any communication in violation of anti-spam laws.

Enforcement

KITSB may suspend or terminate Services immediately and without prior notice upon discovering any violation of this AUP. Repeated or severe violations may result in permanent account closure, forfeiture of fees paid, and referral to law enforcement where applicable.

Indemnity

You agree to indemnify, defend, and hold KITSB harmless from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of this AUP or your misuse of the Services.

Reporting abuse

If you believe a KITSB customer is violating this AUP — for example, sending phishing emails or hosting malware — please report it to abuse@kitsb.com.my with as much detail as possible (URLs, headers, screenshots).
